2. Local Plan First Review 1995-2011

About the Local Plan

The legal framework for the preparation of the Local Plan is the Town and Country Planning Act 1990 (as amended by the Planning and Compensation Act 1991). These acts require us to prepare a Local Plan which forms part of the statutory Development Plan for the whole of our area.

Section 54A of the 1990 Planning Act requires planning applications to be determined in accordance with the Plan unless material considerations indicate otherwise. This helps avoid decisions being made in an arbitrary manner, gives the public the opportunity to shape the way decisions are made and the future of an area and, finally, gives everyone a reasonable level of certainty which can aid the making of property and investment decisions.

Preparation of the Plan

The Deposit Draft of the Exeter Local Plan First Review was published in January 2001. Following consideration of the representations to the Deposit Draft, a Second Deposit was published in May 2002 and a Local Plan Inquiry was held from April to August 2003.

We placed modifications on deposit from 8 October to 19 November.

Executive considered the representations to the modifications on 25 January 2005.

Council resolved to give Notice of Intention to Adopt the Exeter Local Plan First Review after 28 days, and that the Plan be adopted after that period. The Plan was duly adopted on 31 March 2005.
